These Terms of Service ("Terms") are a legal agreement between you and the operator of Probs ("Probs", "we", "us", "our") governing your access to and use of the Probs website and services (the "Service"). By creating an account, subscribing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and have the legal capacity to enter into a contract to use the Service. By using the Service you represent that you meet these requirements, that you are not barred from using it under any applicable law, and that you will comply with all laws and regulations that apply to you, including any governing financial markets and trading in your country.
Probs is an information, education, and entertainment product. It publishes community forecasts, aggregated probabilities, rankings, model-derived projections, and related commentary. Nothing on the Service is, or should be relied on as, financial, investment, tax, legal, or trading advice, a personal recommendation, or an offer, solicitation, or inducement to buy, sell, or hold any security, cryptoasset, or other financial instrument. We are not a broker, dealer, investment adviser, or financial institution; we are not authorised or regulated by the Financial Conduct Authority or any other regulator; and your use of the Service does not create any advisory, fiduciary, or professional-client relationship between you and us. Any decision you make is your own and taken at your own risk, and you should obtain independent advice from an appropriately qualified and regulated professional before making any financial decision.
Trading and investing carry significant risk. The value of investments and cryptoassets can go down as well as up, you may lose some or all of your capital, and past performance and past accuracy are not reliable indicators of future results. Forecasting the future is inherently uncertain: probabilities, consensus figures, projected prices, and expected returns shown on the Service are estimates and opinions that may be materially wrong. You should never make a financial decision based solely on the Service.
Forecasts and rankings reflect the opinions of Service users, not our own views, and we do not verify or endorse them. Aggregated consensus figures and projections are produced by statistical models from those opinions and from third-party data, and are provided for general information only. You acknowledge and agree that, particularly while the community is small, the Service may display sample, placeholder, or seeded data — including illustrative forecasters, forecasts, rankings, consensus figures, and accuracy or track-record statistics — to demonstrate how features work, and that such data does not represent real users, real market activity, or a real track record. This seeded data is replaced by real community data automatically as forecasters participate. Such data may not be individually identified or labelled on the Service, and you agree not to rely on any figure on the Service as representing verified or real activity.
You must provide accurate, current information when registering and keep it up to date. You are responsible for all activity under your account and for keeping your credentials confidential. You may not share your account, create multiple or automated accounts, impersonate others, or register on behalf of anyone else. Notify us promptly of any unauthorised use. We may suspend, restrict, or terminate your account at our discretion, including where we reasonably believe these Terms have been breached.
Certain features are offered through Probs Premium, a paid subscription billed at the price shown at checkout (currently £5 per month) through our payment processor, Stripe. By subscribing, you authorise us and Stripe to charge your payment method on a recurring basis until you cancel, and the subscription renews automatically at the end of each billing period. You can cancel at any time from your account or billing portal; cancellation takes effect at the end of the current period, and you keep access until then. Because Premium provides digital content and services with access granted immediately, you expressly consent to us beginning to provide it right away and acknowledge that, to the extent permitted by law, you thereby lose any statutory 14-day right to cancel for the period already provided. Except where required by law or expressly stated by us, payments are non-refundable and partial periods are not refunded. We may change prices or features on reasonable notice, with changes applying to subsequent billing periods. Your statutory rights as a consumer are not affected.

We may remove content and suspend or terminate accounts that we reasonably believe breach these Terms, and may report unlawful activity to the relevant authorities.
You retain ownership of the forecasts, reasoning, usernames, and other content you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, use, reproduce, and display your User Content for the purpose of operating, promoting, and improving the Service, including in aggregated or anonymised form. You represent that you have the rights to submit your User Content and that it does not breach these Terms or any law. We are not obliged to monitor User Content but may review, moderate, or remove it at our discretion.
If you believe any content on the Service is unlawful, infringes your rights (including copyright), or breaches these Terms, please report it to probsquestions@gmail.com with a link to the content and enough detail for us to assess it. We review reports and may remove content or restrict accounts where we consider it appropriate, but we do not undertake to act on every report.
Market prices and related data are supplied by third parties (including Twelve Data, Finnhub, Yahoo Finance, and CoinGecko) and may be delayed, inaccurate, incomplete, or unavailable. Such data is provided "as is" and is subject to those providers' own terms. The Service also relies on third-party services such as authentication and payment providers; we are not responsible for third-party services, and your use of them is governed by their terms.
The Service and all software, text, design, and graphics we provide (excluding User Content and third-party data) are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written permission.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any forecast, projection, or figure will be accurate or reliable.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or limited; your mandatory statutory rights as a consumer remain unaffected. Subject to that, to the fullest extent permitted by law: (a) we are not liable for any trading, investment, or financial losses, lost profits, lost opportunity, or for any indirect, incidental, special, or consequential loss arising from or in connection with your use of, or reliance on, the Service or any figure it displays; and (b) our total aggregate liability to you for all claims arising out of or relating to the Service in any 12-month period is limited to the greater of the amount you paid us in that period or £100.
You agree to indemnify and hold harmless Probs and its operators from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your breach of these Terms, or your violation of any law or third-party right.
You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time, with or without notice, including for breach of these Terms or where we discontinue the Service. Provisions that by their nature should survive termination — including the disclaimers, limitation of liability, indemnity, and governing-law clauses — will survive.
Our Privacy Policy explains how we collect and use personal data and forms part of these Terms.
We may update these Terms from time to time. Where changes are material we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere you continue to benefit from any mandatory protections of your country of residence and may be entitled to bring proceedings there.
These Terms, together with the Privacy Policy and any terms presented at checkout, form the entire agreement between you and us regarding the Service. We may add, change, or withdraw features of the Service at any time; changes affecting paid features are handled as described under "Premium subscription and payments". If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force. A failure or delay by us in enforcing any provision is not a waiver of it. You may not assign or transfer your rights or obligations under these Terms; we may assign ours to an affiliate or in connection with a merger, acquisition, or sale of assets. Except as expressly stated, these Terms do not confer any rights on any third party, including under the Contracts (Rights of Third Parties) Act 1999.
